Do You Know What Your Rights Are?
Here’s a sample of what you will find in “You and Your Data”:
- Your prospective employer is obligated by law to disclose to you, in writing, that he/she is ordering a background check on you before the report is ordered. You should read it and, if possible, keep a copy of any release form you sign.
- If your prospective employer chooses not to hire you because of information contained in the background check, he/she is required by law to send you a “Notice of Adverse Action” and “A Summary of Your Rights Under the Fair Credit Reporting Act”. A “Notice of Adverse Action” sample is included in “You and Your Data”.
- If you were denied employment because of your background check, you are entitled to a free copy of the report. A sample request document describing how to request your copy of the report is included in “You and Your Data”.
- If you find inaccurate information on your report, you can dispute the information with the background check company. The background check company is required by law to re-investigate and they must do so within 30 days. A sample letter requesting a re-investigation is included in “You and Your Data”.
- If an error is found the background check company must correct the error. They must send a copy of the corrected report to both you and the company that ordered it.
