Do You Know What Your Rights Are?

Here’s a sample of what you will find in “You and Your Data”:

  1. Your prospective employer is obligated by law to disclose to you, in writing, that he/she is ordering a background check on you before the report is ordered. You should read it and, if possible, keep a copy of any release form you sign.
  2. If your prospective employer chooses not to hire you because of information contained in the background check, he/she is required by law to send you a “Notice of Adverse Action” and “A Summary of Your Rights Under the Fair Credit Reporting Act”.  A “Notice of Adverse Action” sample is included in “You and Your Data”.
  3. If you were denied employment because of your background check, you are entitled to a free copy of the report.  A sample request document describing how to request your copy of the report is included in “You and Your Data”.
  4. If you find inaccurate information on your report, you can dispute the information with the background check company.  The background check company is required by law to re-investigate and they must do so within 30 days.  A sample letter requesting a re-investigation is included in “You and Your Data”.
  5. If an error is found the background check company must correct the error. They must send a copy of the corrected report to both you and the company that ordered it.
